DELIVERY AND RECEIPT PROCEDURES
All purchases shall be subject to strict compliance with Pacific Combustion Engineering Companys Delivery and Receipt Procedures: The Purchaser must inspect all product received (e.g. walk around package, look for scratches, dents, chips, gashes and any other visible damage.) The Purchaser must note any damage or shortage at the time of delivery when the damage or shortage is visible or can be ascertained by count. The Purchaser must accept the shipment unless the damage is so great as to render the shipment totally worthless. Notations must be made at the time of delivery and should be as detailed and as precise as possible. The Purchaser should note damages on the delivery receipt and the Purchasers copy, making sure that the names, dates, and notations are complete and legible. The Purchaser should make sure that the drivers signature is legible. Example, if there is a dent in the crate, note on the delivery receipt Possible concealed damage due to dent on crate. Unilateral statements written on the face of the delivery receipt are not binding. This means that any notation that does not appear on both copies of the delivery receipt-original and Purchasers copy-is meaningless. The Purchaser should notify the carrier in writing when damage or shortage is discovered at time of delivery and request an inspection. The Purchaser should be prepared to provide the carrier with an approximate value of the loss. The goods and packaging should be held as is until the carrier has made an inspection or has waived the inspection. The carrier may choose to waive the inspection if the value of the financial damage is under a certain dollar amount. If the carrier waives the inspection, the Purchaser should write down the name of the carrier representative who waived the inspection, note the date and time. CAUTION: FAILURE TO PROMPTLY OPEN AND INSPECT ALL SHIPMENTS UPON DELIVERY CAN GREATLY INCREASE THE DIFFICULTY OF COLLECTING DAMAGES ON A CONCEALED LOSS OR DAMAGE CLAIM. The following list describes the Purchasers responsibilities when concealed damage or shortage is discovered. It is imperative that the Purchaser report concealed damage or shortage to the carrier upon delivery or all rights will be forfeited. The Purchaser must ensure that the goods and packaging are left as they were when the damage or shortage was discovered, until the carrier has made an inspection or has waived the inspection. The Purchaser should be prepared to have employee statements to verify that the damage or shortage did not occur after delivery.
The above outlined Delivery and Receipt Procedures must e used when a shipment is received from Pacific Combustion Engineering Company, otherwise the Purchaser will have taken full responsibility for any claims.
